ph45 Terms & Conditions — Your Rights and Responsibilities

In these Terms & Conditions, the following definitions apply unless context otherwise requires:

• "ph45," "we," "us," or "our" refers to ph45.asia and the legal entity operating the ph45 gaming platform under PAGCOR license.
• "Platform" means the ph45 website at ph45.asia, including all games, wallet functions, sports betting features, promotional mechanisms, and related services accessible through ph45.asia or any subdomain thereof.
• "Account" means the individual player account created by a User to access ph45 services.
• "User," "Player," or "you" means any natural person who has created, or is in the process of creating, a ph45 Account.
• "KYC" (Know Your Customer) means the identity and age verification process required before withdrawals are processed.
• "PAGCOR" means the Philippine Amusement and Gaming Corporation, the regulatory body that licenses and supervises ph45's operations.
• "Bonus Funds" means credits added to a User's Account as part of a promotion, welcome offer, cashback, or any other incentive — distinct from real money deposits.
• "Real Money Funds" means deposits made by a User using GCash, Maya, BPI, BDO, Metrobank, GrabPay, 7-Eleven CLiQQ, USDT, or other approved payment methods.
• "Wagering Requirement" means the number of times bonus funds must be wagered before they — or winnings derived from them — are eligible for withdrawal.
• "Philippine Business Hours" means 9:00 AM to 9:00 PM Philippine Standard Time (PHT), Monday through Sunday.

To register and maintain a ph45 Account, you must at all times:

• Be at least 21 years of age as required by PAGCOR and Philippine gaming law.
• Be a natural person (corporations, trusts, and other legal entities may not hold personal gaming accounts).
• Be legally resident in or physically located within a jurisdiction where accessing online gaming through ph45 is not prohibited by applicable local law.
• Not be a current employee, contractor, officer, or director of ph45, or an immediate family member of any such person.
• Not be a person who has previously been permanently excluded from ph45 or any PAGCOR-licensed platform.
• Have full legal capacity to enter into a binding agreement under Philippine law.

ph45 reserves the right to request proof of age, residency, and identity at any time. Accounts found to be operated by persons under 21 will be immediately and permanently closed. Any Real Money Funds in such accounts will be returned to the depositing payment method. Bonus Funds and any winnings derived from bonus funds will be forfeited in full.

By registering, you represent and warrant that you meet all eligibility criteria listed above. Misrepresentation of your eligibility constitutes a material breach of these Terms.

3.1 Registration Requirements

When registering for a ph45 Account, you must provide accurate, complete, and current information including your full legal name, date of birth, Philippine mobile number, and any other information requested during the registration process. You agree to maintain the accuracy of this information and to update it promptly if it changes.

3.2 One Account Per Person — Strict Enforcement

Each individual person may hold only one ph45 Account at any given time. The registration of multiple accounts by the same individual ("duplicate accounts") is strictly prohibited. ph45 uses device fingerprinting, IP address analysis, payment method cross-referencing, and identity document verification to detect duplicate accounts. Upon detection:

• All accounts linked to the individual will be suspended pending investigation.
• All Bonus Funds, bonus-derived winnings, and any proceeds linked to prohibited account activity will be forfeited.
• Real Money Funds that can be traced to legitimate deposits may be returned at ph45's sole discretion, subject to verification.
• The individual may be permanently barred from the ph45 platform.

3.3 Account Security

You are solely responsible for maintaining the confidentiality of your account credentials. ph45 will never ask for your password via chat, SMS, email, or phone. You must notify ph45 immediately if you suspect unauthorised access to your account. ph45 is not liable for losses arising from your failure to maintain password security.

3.4 Accurate Information Obligation

All information provided to ph45 must be truthful and accurate. Providing false, misleading, or fabricated information — including falsifying identity documents, misrepresenting age, or using another person's identity — constitutes fraud and may result in criminal liability under Philippine law in addition to permanent account termination.

ph45 is required under PAGCOR regulations and the Philippine Anti-Money Laundering Act (AMLA) to verify the identity of all account holders. KYC verification is mandatory before the first withdrawal is processed and may be requested again at any time for enhanced due diligence purposes.

4.1 Standard KYC Documents

ph45 accepts the following Philippine government-issued identification documents for KYC verification:

• PhilSys National ID
• UMID (Unified Multi-Purpose ID)
• Philippine Passport
• LTO Driver's Licence
• PRC Professional Regulation Card
• Voter's ID / COMELEC ID
• SSS / GSIS ID
• Postal ID (issued 2015 or later)

Documents must be clear, legible, unexpired, and show the bearer's photograph, full name, and date of birth. Photos of damaged, expired, or partially obscured documents will not be accepted.

4.2 Enhanced Due Diligence

For accounts with cumulative deposits or withdrawals exceeding thresholds defined by Philippine AMLA regulations, or where unusual transaction patterns are detected, ph45 may request additional documentation including proof of address, source of funds declarations, or bank statements. Refusal to provide enhanced due diligence documentation will result in account restriction and reporting obligations under AMLA.

4.3 Verification Timeline

Standard KYC submissions are reviewed within 24 hours during Philippine Business Hours. Submissions requiring enhanced review may take up to 5 business days. ph45 will notify you via SMS upon verification approval or rejection, with reasons provided for rejection.

5.1 Accepted Payment Methods

ph45 currently accepts deposits and processes withdrawals via the following methods: GCash, Maya (PayMaya), BPI, BDO, Metrobank, GrabPay, 7-Eleven CLiQQ (deposits only), and USDT TRC20. ph45 reserves the right to add, modify, or remove payment methods at any time with reasonable notice.

5.2 Minimum Deposit

The minimum deposit amount at ph45 is ₱100. ph45 does not charge deposit fees. Any fees charged by your payment provider (e.g., GCash transaction fees) are outside ph45's control and are the User's responsibility.

5.3 Withdrawal Terms

• KYC verification must be completed before any withdrawal is processed.
• Withdrawals are processed to the same payment method used for deposits where technically possible ("same-source rule"), as required by anti-money laundering regulations.
• GCash and Maya withdrawals are typically processed within 5 minutes of approval. Bank transfer withdrawals (BPI, BDO, Metrobank) are typically processed within 30 minutes on business days.
• ph45 does not charge withdrawal fees. Transfer times depend on your payment provider's processing speed.
• The minimum withdrawal amount is ₱200.
• Withdrawal requests may be subject to additional review for accounts where unusual transaction activity is detected.

5.4 Currency

All transactions on the ph45 platform are conducted in Philippine Peso (PHP / ₱) unless otherwise explicitly stated. USDT transactions are converted at the prevailing exchange rate at the time of the transaction.

All bonuses and promotions offered by ph45 are subject to specific terms and conditions that are communicated at the point of offer. The following general provisions apply to all ph45 promotional offers unless specific bonus terms state otherwise:

• Wagering requirements: Bonus funds must typically be wagered between 25× and 40× (depending on the specific offer) before withdrawal of bonus funds or bonus-derived winnings is permitted.
• Game restrictions: Certain games may contribute at different rates toward meeting wagering requirements, or may be excluded entirely from bonus wagering. Live baccarat, for example, may contribute at a lower rate (e.g., 10%) than slots (typically 100%).
• Expiry: All bonuses have an expiry date. Bonus funds and associated wagering requirements that have not been met before the expiry date will be automatically removed from your account.
• Minimum bet limits: While bonus funds are active, maximum single bet limits may apply. Bets exceeding these limits while bonus funds are active may result in winnings from those bets being voided.
• One active bonus at a time: ph45 allows only one active bonus per account at any time. Claiming a new bonus while a previous bonus is still active requires forfeiting the existing bonus.
• Bonus abuse: Any detected attempt to abuse bonus conditions — including creating multiple accounts, using arbitrage betting strategies, or coordinating with other players — will result in forfeiture of all bonuses and associated winnings, and may result in permanent account termination.

By claiming any ph45 bonus or promotion, you confirm that you have read and accepted the specific terms of that offer. ph45 reserves the right to modify or withdraw any promotion at any time.

All casino games available on the ph45 platform are supplied by licensed third-party game studios including, but not limited to, JILI Games, Evolution, Pragmatic Play, PG Soft, NetEnt, and Microgaming. Each game provider holds independent certifications from internationally recognised testing laboratories (including eCOGRA, iTech Labs, and GLI) verifying the integrity of their Random Number Generator (RNG) software.

7.1 Game Outcomes

All game outcomes are determined exclusively by the provider's certified RNG software. ph45 does not have the ability to influence, modify, or manipulate individual game outcomes. 7.2 Disconnection Policy

If a network interruption occurs during an active game round, ph45's system records the state of the game at the point of disconnection. Users are encouraged to maintain a stable internet connection before initiating high-value bets.

7.3 Malfunction Voids All Pays

In the event of a game or software malfunction, all affected wagers and payouts from the malfunctioning session are void. ph45 will return the original stake amount for any bet placed during a confirmed malfunction period. ph45 will not honour payouts that resulted from a game malfunction, regardless of the displayed outcome.

7.4 Sports Betting

All sports bets are subject to the specific rules of the relevant sport and the ph45 Sports Betting Rules, which are published separately within the sports betting section of the platform. ph45 reserves the right to void, suspend, or cancel sports bets in cases of clear pricing errors, bet manipulation, or where the integrity of an event is in question.

The following conduct is strictly prohibited on the ph45 platform. Violation of any provision below may result in immediate account suspension, permanent termination, forfeiture of all funds, and reporting to PAGCOR and relevant Philippine law enforcement authorities:

• Age misrepresentation: Using false identification to create an account while under 21 years of age.
• Identity fraud: Creating an account using another person's identity, documents, or payment methods without their explicit legal consent.
• Multiple accounts: Operating more than one ph45 account, whether under the same or different identity.
• Collusion: Coordinating with other players to manipulate game outcomes, share hole cards in poker, or engage in any form of teamplay designed to gain an unfair advantage.
• Use of prohibited software: Using bots, automated betting software, card-reading software, AI assistance tools, or any external program designed to gain an advantage over the game's natural odds.
• Chargeback fraud: Initiating a payment reversal (chargeback) with a bank or payment provider after using deposited funds on the platform.
• Exploitation of errors: Knowingly exploiting software errors, display errors, or pricing errors to place bets at incorrect odds or on unavailable outcomes.
• Money laundering: Using ph45 as a vehicle to deposit, circulate, or withdraw funds derived from illegal activity, in violation of the Philippine Anti-Money Laundering Act.
• Threatening or abusive behaviour: Directing threatening, abusive, discriminatory, or harassing communication toward ph45 staff or other platform users.
• Bonus abuse: Systematically exploiting promotional offers in a manner inconsistent with genuine recreational play, as determined by ph45 at its sole discretion.

All content on the ph45 platform — including but not limited to the ph45 brand name, logo, website design, game interfaces, promotional materials, written content, graphics, audio, video, and software — is the exclusive intellectual property of ph45 or its licensed content providers, and is protected under Philippine intellectual property law and applicable international treaties.

Users are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the ph45 platform solely for personal, non-commercial recreational purposes. This licence does not permit:

• Copying, reproducing, distributing, or creating derivative works from any ph45 content.
• Reverse engineering, decompiling, or disassembling any ph45 software.
• Using ph45 trademarks, trade names, or branding without prior written authorisation.
• Scraping, data-mining, or systematically extracting content from the ph45 platform.

Any unauthorised use of ph45 intellectual property constitutes a breach of these Terms and may result in legal action under the Intellectual Property Code of the Philippines.

To the maximum extent permitted under Philippine law, ph45 shall not be liable for:

• Any loss of profits, revenue, data, goodwill, or indirect, incidental, consequential, special, or punitive damages arising from your use of — or inability to use — the ph45 platform, even if ph45 has been advised of the possibility of such damages.
• Losses arising from network interruptions, third-party payment processing delays, or failures of systems operated by GCash, Maya, BPI, BDO, Metrobank, GrabPay, or any other third-party service provider.
• Unauthorised access to your ph45 Account resulting from your failure to maintain password security or your disclosure of credentials to a third party.
• Any inaccuracy in live sports data, odds, or game information provided by third-party data suppliers.
• The content, reliability, or operation of third-party websites or services linked from or to the ph45 platform.

ph45's total aggregate liability to any individual User for any claim arising under or in connection with these Terms shall not exceed the total net deposits made by that User in the 30-day period immediately preceding the event giving rise to the claim.

Nothing in these Terms excludes or limits ph45's liability for fraud, gross negligence, or any liability that cannot be limited by applicable Philippine law.

ph45 reserves the right to suspend, restrict, or permanently terminate any User Account — with or without prior notice — under the following circumstances:

• Breach of any provision of these Terms & Conditions.
• Failure to complete KYC verification within the required timeframe.
• Detection of prohibited conduct as described in Section 8.
• Account found to belong to a person under 21 years of age.
• Regulatory requirement or PAGCOR direction.
• Suspected money laundering or financial fraud.
• Account inactivity for a period exceeding 24 consecutive months.
• Self-exclusion request by the Account holder.

Upon permanent account termination for cause (i.e., breach of Terms), ph45 may forfeit all Bonus Funds, bonus-derived winnings, and any funds involved in the prohibited conduct. Real Money Funds that can be identified as legitimately deposited may be returned at ph45's sole discretion, subject to completion of all required verification and applicable withholding obligations.

Users who wish to close their account voluntarily may do so by contacting ph45 customer support. Voluntarily closed accounts with positive real money balances will have those balances returned to the depositing payment method following standard KYC completion and withdrawal processing timelines.

ph45 takes its responsible gaming obligations seriously and provides the following tools to all registered Users. These tools are accessible from Account Settings and take effect immediately upon activation:

• Deposit Limits: Set daily, weekly, or monthly deposit limits on your account. Limits can be decreased immediately; increases are subject to a 24-hour cooling-off period.
• Session Time Limits: Set maximum continuous session durations. Once reached, your session ends automatically and a break is enforced.
• Loss Limits: Set maximum net loss thresholds for a given period. Once reached, further play in that period is suspended.
• Reality Checks: Opt in to receive notifications at set intervals reminding you of how long you have been playing and your net session result.
• Cooling-Off Periods: Take a break from ph45 for a defined period (24 hours, 7 days, 30 days). During a cooling-off period, your account is suspended but not closed, and funds are preserved.
• Self-Exclusion: Request permanent exclusion from the ph45 platform. Self-exclusion is irrevocable for the duration selected (minimum 6 months, maximum permanent). Self-excluded users are removed from all promotional communications.

ph45 complies with all PAGCOR responsible gaming requirements and cooperates with PAGCOR's national self-exclusion programme. Users who have registered on the PAGCOR self-exclusion list will be denied access to ph45 upon detection.

ph45 reserves the right to amend, update, or replace these Terms & Conditions at any time. Where changes are material — affecting your rights, financial obligations, or dispute resolution mechanisms — ph45 will provide notice via:

• A prominent notice displayed on the ph45 website for a minimum of 14 days prior to the effective date of the changes.
• An SMS notification to your registered mobile number, where technically feasible.
• An in-platform notification upon your next login following the update.

Your continued use of the ph45 platform after the effective date of any amendment constitutes your acceptance of the revised Terms. If you do not accept the revised Terms, you must cease using the ph45 platform and close your account before the effective date. Non-material amendments (such as clarifications, corrections of typographical errors, or changes to contact information) may be made without prior notice.

These Terms & Conditions and all matters arising from your use of the ph45 platform are governed by, and shall be construed exclusively in accordance with, the laws of the Republic of the Philippines, without regard to its conflict of laws provisions.

You irrevocably submit to the exclusive jurisdiction of the courts of the Philippines for the resolution of any dispute, claim, or controversy arising out of or relating to these Terms, your ph45 Account, or any use of the ph45 platform. This includes disputes regarding the formation, interpretation, performance, breach, termination, or validity of these Terms.

ph45 is licensed and regulated by the Philippine Amusement and Gaming Corporation (PAGCOR). Players who have unresolved complaints against ph45 may escalate their complaint to PAGCOR through PAGCOR's official complaint process. PAGCOR's contact information is publicly available on the PAGCOR official website.

Nothing in this section limits any mandatory consumer rights you hold under Philippine law that cannot be waived by contractual agreement.

ph45 customer support is available 24 hours a day, 7 days a week, including Philippine public holidays. The primary support channel is live chat, accessible from the ph45 website after logging in. Support is provided in English and Filipino.

15.1 Complaint Resolution Process

If you have a complaint regarding your ph45 Account, a game outcome, a payment, or any other platform matter, ph45 requests that you proceed through the following stages:

1. Stage 1 — Initial Contact: Contact ph45 live chat support with full details of your complaint, including your account reference number, the date and time of the relevant event, and the nature of your complaint. Most complaints are resolved at this stage within 24 hours.
2. Stage 2 — Formal Escalation: If your Stage 1 complaint is not resolved to your satisfaction, submit a formal written complaint via email to [email protected]. Include all relevant documentation. ph45's formal complaints team will respond within 5 business days.
3. Stage 3 — PAGCOR Escalation: If your formal complaint is not resolved to your satisfaction after Stage 2, you may escalate your complaint to PAGCOR through their official complaint resolution process. ph45 will cooperate fully with any PAGCOR-initiated investigation.
